the hemp ban and denver

intoxicating hemp products like delta-8 are already banned in colorado. sb 23-271, effective june 7, 2023, sorts hemp cannabinoids into non-intoxicating, potentially intoxicating, and intoxicating tiers and confines intoxicating products to the licensed marijuana market. chemically converted cannabinoids such as delta-8 and delta-10 have been prohibited since 2021 state health department guidance. general retail may sell only low-dose product, capped at 1.75mg thc per serving at a 15:1 cbd ratio. sb26-164, which would have opened a hemp beverage channel, was postponed indefinitely in april 2026. colorado already restricts intoxicating hemp to licensed cannabis channels. section 781 has minimal direct impact on smoke shops outside the cannabis system; impact concentrated in transitional inventory that bridged previous state-level restrictions.
