intoxicating hemp products are restricted in illinois. sb 3222, signed by governor pritzker on june 12, 2026, immediately banned sales of intoxicating hemp to anyone under 21. from november 12, 2026 the new illinois hemp act reclassifies any hemp product above 0.4mg total thc per container as cannabis, sellable only inside the licensed adult-use cannabis system, naming delta-8, delta-9, thc-p and hhc. illinois has both a robust hemp-derived cannabinoid market and an adult-use cannabis program. section 781 will reduce smoke shop inventory significantly; some shops may pursue licensed cannabis ancillary services, but the state cannabis license itself is competitive and expensive.
